This Agreement is subject to change by WriteWork.com at any time; therefore, you are responsible to review these terms regularly to learn about any changes.
The laws of Brazil govern this Agreement. You hereby irrevocably consent to the exclusive jurisdiction and venue of the courts in Brasilia, Federal District, Brazil, in all disputes arising out of or relating to the use of WriteWork.com's services.
1. Acceptance of Agreement Terms
2. Website Access and Use
2.1. Access Rules. WriteWork hereby grants you permission to use the WriteWorkWebsite as set forth in this Agreement, provided that: (i) you use the WriteWork Website solely for your personal, noncommercial use, (ii) you will not copy or distribute any part of the WriteWork Website in any medium without WriteWork's prior written authorization, (iii) you will not alter or modify any part of the WriteWork Website, (iv) you will comply with the terms and conditions of this Agreement, and (v) you will comply with all applicable laws and regulations relating to your access to and use of the WriteWork Website.
2.2. Account. In order to access some features of the WriteWork Website, you will have to create an account. You may never use another WriteWork Website user's account without such user's permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify WriteWork immediately of any breach of security or unauthorized use of your account. Although WriteWork will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of WriteWork or others due to such unauthorized use. You are responsible for terminating each session by following the proper log out directions provided by the WriteWork Website. WriteWork shall not be responsible for any damage arising from your failure to comply with this Section 2.2.
2.4. There is a daily view limit. This means that in a 24 hour period a maximum of 70 essays can be viewed.
2.5 No material within the site may be transferred to any other person or entity, whether commercial or non-commercial. You may not modify, alter, resell, redistribute, sublicense, display or make derivative works of any materials or content provided on WriteWork.com.
3. Proprietary Materials
The content on the WriteWork Website, except all User Submissions (as defined below) ("Content") and the trademarks, service marks and logos contained on the WriteWork Website, are owned by or licensed to WriteWork, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. Content on the WriteWork Website is provided to you "AS IS" for your information and personal use only and may not be used, copied, distributed, displayed, or otherwise exploited for any other purposes whatsoever without the prior written consent of WriteWork. WriteWork reserves all rights not expressly granted in and to the WriteWork Website and the Content. You agree to not engage in the use, copying, distribution or display of any of the Content or User Submissions of third parties other than expressly permitted in this Agreement, including any use, copying, distribution or display of User Submissions of third parties obtained through the WriteWork Website for any commercial purposes.
4. User Submissions
4.1. No Guarantee of Confidentiality. The WriteWork Website permits the submission of essays or other written works submitted by you and other users ("User Submissions") and the hosting, sharing, and/or publishing of such User Submissions. You understand that whether or not such User Submissions are published, WriteWork does not guarantee any confidentiality with respect to any submissions.
4.2. Ownership Rights. You retain all of your ownership rights in your User Submissions. However, by submitting the User Submissions to WriteWork, you hereby grant WriteWork a worldwide, non-exclusive, perpetual, royalty-free, sublicenseable and transferable license to use, copy, distribute and display the User Submissions in connection with the WriteWork Website and WriteWork's (and its successor's) business. You also hereby grant each user of the WriteWork Website a non-exclusive license to access your User Submissions through the WriteWork Website, and to use, copy, distribute and display such User Submissions as permitted through the WriteWork Website and under this Agreement. The foregoing license granted by you terminates once you remove or delete a User Submission from the WriteWork Website.
4.3. True Author and Proper Citation of Sources. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with your User Submissions, you agree that:
4.3.1. True Author. You will only make submissions to the WriteWork Website if you are the true author of such User Submissions and have the right to use and to authorize WriteWork to use all copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the WriteWork Website and this Agreement; and
4.3.2. Proper Acknowledgement of Sources. You will properly acknowledge every identifiable third party source of information in your User Submissions through proper citation so as to enable inclusion and use of the User Submissions in the manner contemplated by the WriteWork Website and this Agreement.
4.4. Submission Rules. In connection with User Submissions, you agree that you will not: (i) submit material that is copyrighted or otherwise subject to third party proprietary rights, unless you are the owner of such rights and can grant WriteWork all of the license rights related to such User Submissions, (ii) publish falsehoods or misrepresentations that could damage WriteWork or any third party, (iii) submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate, (iv) post advertisements or solicitations of business, or (v) impersonate another person.
4.5. Consequences of Intellectual Property Right Infringement. WriteWork does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and WriteWork expressly disclaims any and all liability in connection with User Submissions. WriteWork does not permit copyright infringing activities and other infringement of intellectual property rights on the WriteWork Website, and WriteWork will remove a User Submission if properly notified that such User Submission infringes on another's intellectual property rights. WriteWork reserves the right to remove a User Submission without prior notice. WriteWork will also terminate a WriteWork Website user's access to the WriteWork Website for repeat infringers. A repeat infringer is a WriteWork Website user who has been notified of infringing activity more than twice and/or has had a User Submission removed from the WriteWork Website more than twice. For violations other than copyright infringement and infringement of other intellectual property rights, WriteWork also reserves the right to decide whether a User Submission is appropriate and complies with this Agreement. WriteWork may at its sole discretion remove such User Submission and/or to terminate a WriteWork Website user's access for submitting such material in violation of this Agreement at any time and without prior notice.
You agree to defend, indemnify and hold harmless WriteWork, its officers, directors, employees, agents, operators, affiliates, licensors and owners, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the WriteWork Website, (ii) your violation of any term of this Agreement, (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right, (iv) any claim that one of your User Submissions caused damage to a third party, or (v) your negligence or willful misconduct. This defense and indemnification obligation will survive this Agreement and your use of the WriteWork Website.
6. Warranty Disclaimer
6.1. WriteWork Website. You agree that your use of the WriteWork Website shall be at your sole risk. The WriteWork Website is provided "AS IS" without warranty of any kind, whether expressed or implied, including but not limited to any warranty as to the quality, accuracy, adequacy, completeness, currency, correctness, reliability or validity of the Content or User Submissions provided by or through the WriteWork Website, and the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality, accuracy, adequacy, completeness, currency, correctness, reliability or validity of any Content or User Submissions rests with the WriteWork Website user. To the fullest extent permitted by law, WriteWork, its officers, directors, employees, agents, operators, affiliates, licensors and owners disclaim all warranties, express or implied, in connection with the WriteWork Website and your use of the WriteWork Website. WriteWork's liability shall be limited as contemplated in Section 7.2 of this Agreement.
6.2. Third Party Websites. WriteWork does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the WriteWork Website or any hyperlinked third party website or featured in any banner or other advertising. WriteWork will not be a party to or in any way be responsible for monitoring any transaction between you and any third-party providers of products or services. WriteWork's liability shall be limited as contemplated in Section 7.2 of this Agreement
7. Limitation on Liability
7.1. Waiver. You understand that when using the WriteWork Website, you will be exposed to User Submissions from a variety of sources, and that WriteWork is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against WriteWork with respect to all User Submissions.
7.2. No Liability. WriteWork, its officers, directors, employees, agents, operators, affiliates, licensors and owners assume no liability or responsibility, and shall not be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any: (i) errors, mistakes, omissions or inaccuracies of Content or User Submissions, (ii) loss, personal injury or damage of any nature whatsoever, resulting from your access to and use of the WriteWork Website, (iii) any unauthorized access to or use of WriteWork's secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from the WriteWork Website, (iv) any bugs, viruses, Trojan horses, or any other harmful component, which may be transmitted to or through the WriteWork Website by any third party, (v) any delay or failure to perform resulting directly or indirectly from any causes beyond WriteWork's control, or (vi) product or service advertised or offered by a third party through the WriteWork Website, or through any hyperlinked third party website accessible from the WriteWork Website, or as featured in any banner or other advertising on the WriteWork Website.
7.3. Acknowledgment. You specifically acknowledge that WriteWork shall not be liable for any User Submissions or the defamatory, offensive, or illegal conduct of any third party whatsoever and that the risk of harm or damage from the foregoing rests entirely with you.
WriteWork may terminate your right to access the WriteWork Website at any time, with or without cause, in WriteWork's absolute discretion and without notice. Section 4.5 of this Agreement which provides specific grounds for termination of your right to access the WriteWork Website shall in no manner whatsoever limit WriteWork's absolute right to terminate your access to the WriteWork Website under this Section 9.
You are not entitled to a refund of your subscription fee if you request to cancel or terminate your membership. You are liable for charges incurred by you until termination of service. You are responsible for any charges imposed by your credit card issuing bank for exceeding your account limits or overdrawing your account.
10.1. Modification of Agreement Terms. WriteWork has a right to modify the terms of this Agreement in any manner and at any time, with or without cause, in WriteWork's absolute discretion and without notice or liability. Any modification is effective immediately upon posting on the WriteWork Website. Your continued use of the WriteWork Website following any modification of the terms of this Agreement shall be conclusively deemed an acceptance of any modification. Your only right with respect to any dissatisfaction with any such modification is to cease use of the WriteWork Website.
10.2. Modification of WriteWork Website. WriteWork may at any time, without notice or liability, change or eliminate any content or feature of the WriteWork Website, or restrict the use of any portion of the WriteWork Website. Your only right with respect to any dissatisfaction with any modification, including any service-related change or elimination, is to cease use of the WriteWork Website.
11. Governing Law
This Agreement is governed by the laws of Brazil, without reference to conflict of laws principles. The Court of Brasilia in Brazil shall have exclusive jurisdiction to adjudicate any dispute arising out of or relating to this Agreement, and you hereby expressly consent to such personal jurisdiction.
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be ignored and the remaining provisions of this Agreement shall remain valid and enforceable.
The failure of WriteWork to act with respect to a breach by you does not waive WriteWork's right to act with respect to subsequent or similar breaches.
This Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by WriteWork without restriction.
15. Entire Agreement
This Agreement sets forth the entire understanding and agreement between WriteWork and you with respect to the subject matter hereof and supersedes any prior understandings or agreements with respect to such subject matter.
You affirm that you are either more than eighteen (18) years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Agreement, and to abide by and comply with this Agreement. In any case, you affirm that you are over the age of thirteen (13), as the WriteWork Website is not intended for children under thirteen (13) years of age. If you are under thirteen (13) years of age, then please do not use the WriteWork Website.
Fee-based memberships and services are offered with the following conditions:
Billing: You agree to pay all fees and charges that you incur subject to the payment terms that will be disclosed to you at the time you make your purchase. When you make a purchase from us, you must provide us with a payment method. You must be authorized to use the payment method. You authorize us to charge you for the service using your payment method. You will pay service charges in advance.
Automatic Recurring Billing: As determined by the content provider of the site, subscription fees may be automatically renewed at the end of the original term selected, for a similar period of time, unless notice is received from the subscriber seven (7) days before renewal. Unless and until this Agreement is cancelled in accordance with the terms hereof, you hereby authorize WriteWork.com to charge your chosen payment method to pay for the ongoing cost of membership. You hereby further authorize us to charge your chosen payment method for any and all additional purchases of services and entertainment provided by the site.
Refunds: Subscription fees are NOT refundable if you request to cancel or terminate your membership. Should a refund be issued by us, all refunds will be credited solely to the payment method used in the original transaction. We will not issue refunds by cash, check, or to another credit card or payment mechanism.
18. Claims of copyright infringement.
The Digital Millennium Copyright Act is a United States law that went into effect in 1998. The DMCA changed the existing Copyright Act to add limitations on the liability of online service providers for copyright infringement and describes processes for copyright holders to report suspected infringement. -
If you believe that material on this site violates your copyright, you may send WriteWork a copyright infringement notice. Section 512(c) of the Copyright Act requires that your notice must be in writing and must include substantially all of the following:
1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit WriteWork to locate the material. WriteWork requests that complete URLs for each instance of the allegedly infringing material be provided.
4. Information reasonably sufficient to permit WriteWork to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the copyright infringement notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please be aware that Section 512(f) of the Copyright Act provides that any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.
Your written copyright infringement notice must be sent to WriteWork’s designated copyright agent via mail or email.
